Do Not Sell or Share My Personal Information

1. Purpose

This page explains the California right to opt out of the sale or sharing of personal information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), and how a California resident may exercise that right with CleverXEL LLC when the right applies.

This page supplements the CleverXEL Privacy Notice. It should be read together with that notice, which describes the categories of personal information we collect, the purposes for which we use it, the categories of recipients to whom information may be disclosed, and other privacy rights that may apply.

2. What “Sell” and “Share” Mean Under California Law

Under the CCPA, “sale” is broader than an ordinary cash transaction and may include certain transfers of personal information to another party for monetary or other valuable consideration. “Sharing” generally refers to disclosing personal information to a third party for cross-context behavioral advertising, whether or not money is exchanged.

Not every disclosure of personal information is a sale or sharing. California law excludes or separately treats certain disclosures, including qualifying disclosures to service providers, contractors, and other parties operating under applicable statutory and contractual conditions.

3. CleverXEL’s Current Position

CleverXEL does not publish this page as a representation that every CCPA requirement applies to the company in every circumstance. CCPA applicability depends on statutory thresholds, the nature of the company’s activities, and the way personal information is collected, used, disclosed, sold, or shared.

CleverXEL does not knowingly sell personal information for direct monetary payment. If any website, advertising, analytics, marketing, or other technology used by CleverXEL constitutes a “sale” or “sharing” under applicable California law, California residents may exercise the opt-out rights described on this page.

CleverXEL periodically reviews its website technologies and data practices. If those practices materially change, this page and the Privacy Notice will be updated as appropriate.

4. Your Right to Opt Out

If CleverXEL sells or shares personal information as those terms are defined by the CCPA, a California resident has the right to direct CleverXEL not to sell or share that resident’s personal information.

Once a valid opt-out request is received and applicable, CleverXEL will process the request in accordance with applicable law and will not require the individual to create an account solely to exercise the opt-out right.

5. How to Submit a Request

A California resident may submit a request to opt out of the sale or sharing of personal information by contacting CleverXEL at clients@cleverxel.com and using the subject line “Do Not Sell or Share My Personal Information.”

The request should provide enough information for CleverXEL to identify the person or browser/device associated with the request where reasonably necessary. CleverXEL will not require identity verification that is disproportionate to the nature of an opt-out request, although limited information may be requested when needed to identify the information or activity to which the request applies.

If CleverXEL later implements an online privacy-choice tool, cookie-preference mechanism, or dedicated privacy request form, that mechanism may also be used to submit applicable opt-out choices.

6. Global Privacy Control

Where required by the CCPA, CleverXEL will recognize a valid browser- or device-based opt-out preference signal, including Global Privacy Control (“GPC”), as a request to opt out of sale or sharing for the browser or device from which the signal is received.

A GPC signal may not identify the individual by name and therefore may apply only to the browser, device, or profile associated with the signal unless the signal can reasonably be linked to an identified consumer in accordance with applicable law.

7. Authorized Agents

Where permitted by California law, a California resident may use an authorized agent to submit an opt-out request. CleverXEL may request information reasonably necessary to confirm the agent’s authority or to identify the consumer to whom the request relates, consistent with the CCPA and its regulations.

8. No Discrimination

CleverXEL will not unlawfully discriminate against a California resident for exercising a privacy right provided by applicable law. Exercising the right to opt out will not, by itself, result in unlawful denial of services, unlawful differential treatment, or another prohibited form of retaliation.

9. Children and Minors

CleverXEL does not knowingly sell or share the personal information of consumers under 16 years of age without the affirmative authorization required by applicable California law. If CleverXEL learns that personal information of a minor has been handled in a manner requiring additional action under the CCPA, the company will evaluate and address the matter in accordance with applicable law.

10. Sensitive Personal Information

California law provides a separate right, in specified circumstances, to limit certain uses and disclosures of sensitive personal information. If CleverXEL engages in a use or disclosure that triggers that right, the company will provide an appropriate mechanism for California residents to exercise the right to limit, which may be combined with other privacy choices through a “Your Privacy Choices” or “Your California Privacy Choices” mechanism where permitted.

11. Timing and Processing

CleverXEL will process applicable opt-out requests as soon as reasonably practicable and within the period required by California law. The company will also apply applicable opt-out choices to relevant third-party technologies or business processes to the extent required and reasonably within its control.

12. Changes to This Policy

CleverXEL may update this policy when its data practices, website technologies, legal obligations, or applicable privacy laws change. Material changes will be reflected by an updated effective or revision date.
